Genuine Self-Employment and Collective Agreements of Solo Self-Employed Persons Unofficial title

Ensuring the determination of the correct employment status of persons performing platform work should not prevent the improvement of conditions of genuine self-employed persons performing platform work. The Commission communication of 30 September 2022, which contains ‘Guidelines on the application of Union competition law to collective agreements regarding the working conditions of solo self-employed persons’ and indicates that, according to the Commission, collective agreements between solo self-employed persons and digital labour platforms relating to working conditions fall outside the scope of Article 101 TFEU, can, to that end, serve as useful guidance. It is crucial, however, that the introduction of those collective agreements does not undermine the objectives pursued by this Directive, in particular the correct classification of persons performing platform work with regard to their employment status.
