Existing Union Rules on Working Conditions and on Information and Consultation Unofficial title

A body of legal instruments provides for minimum standards in working conditions and labour rights across the Union. This includes, in particular, Directives 2003/88/EC (4), 2008/104/EC (5) and (EU) 2019/1152 (6), of the European Parliament and of the Council, and other specific instruments on aspects such as health and safety at work, pregnant workers, work-life balance, fixed-term work, part-time work, and the posting of workers. In addition, the Court of Justice of the European Union (the ‘Court of Justice’) has ruled (7) that ‘stand-by’ time, during which the worker’s opportunities to carry out other activities are significantly restricted, is to be regarded as working time. Directive 2002/14/EC of the European Parliament and of the Council (8) establishes a general framework setting out minimum requirements for the right to information and consultation of employees in undertakings or establishments within the Union.
